By accessing or using our platform—including our website, mobile applications, and related services (collectively, “Museums.com” or “the Site”)—you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use our services.
To use certain features of Museums.com, such as uploading artwork or participating in auctions, you must register for an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account and password.
You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account.
Museums.com is powered by its community. Artists, galleries, and museums upload content including artwork, images, descriptions, and event information. Users may also leave public comments.
By submitting content, you grant Museums.com a worldwide, royalty-free, non-exclusive license to use, display, and promote your content on and through our platform. You represent that you own or have rights to the content you post.
We reserve the right to remove content that violates our guidelines, infringes intellectual property, or is offensive, fraudulent, or misleading.
All users may upload artwork, but only curated listings will appear in our homepage features, promotional sections, or "invited member" areas. Curation is determined solely by our editorial team and is subject to change.
Museums.com acts as an intermediary connecting buyers and sellers. We do not own or warehouse artwork. All sales are facilitated through Escrow.com APIs or cryptocurrency-based escrow services (BTC, ETH, USDT, USDC).
Once a buyer places an order, funds are held in escrow until the artwork has been shipped by the seller and successfully received by the buyer. After confirmation, we release funds to the seller.
Museums.com may charge transaction fees or service fees, which will be disclosed prior to purchase.
We offer membership packages to artists, galleries, and museums with different features, including expanded profiles, visibility, and promotional opportunities. checkout. By purchasing a membership, you agree to these terms.
Memberships are non-refundable and are billed as described during checkout. By purchasing a membership, you agree to these terms.
◉ Memberships: All membership sales are final and non-refundable.
◉ Art Sales: While funds are held in escrow, both buyer and seller may raise disputes regarding damage, non-receipt, or other issues. Museums.com provides a structured dispute resolution process similar to platforms like Freelancer.com.
You may not use Museums.com to:
◉ Violate any law or regulation;
◉ Infringe upon the rights of others;
◉ Upload or share unlawful, defamatory, or obscene content;
◉ Circumvent our platform, attempt to negotiate outside our system, or avoid paying applicable fees;
◉ Spam, phish, or misuse our communication systems;
◉ Interfere with platform performance or security.
Violations may result in content removal, account suspension, and potential legal action.
All platform content (excluding user submissions)—including our name, logo, interface design, and software—is owned or licensed by Museums.com and protected by intellectual property laws.
Users may not copy, reverse-engineer, or exploit our content without written permission.
We reserve the right to suspend or terminate your account or access to the platform at any time, with or without cause. In cases of fraud or policy abuse, we may withhold funds and ban accounts without prior notice.
Museums.com may update these Terms at any time. When we do, we’ll revise the “Last updated” date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
To the maximum extent allowed by law, Museums.com and its affiliates are not liable for indirect, incidental, special, or consequential damages—including lost profits, data loss, or damage to artwork—arising from the use of our platform.
We are not liable for the acts or omissions of users or third-party vendors.
These Terms are governed by the laws of Delaware, USA, without regard to conflict of laws principles. Any legal action shall be brought in the courts of Delaware, USA.
